1. Who we are
AcoustaPLOT Echo is provided by AcoustaPLOT Ltd, a company registered in England and Wales (company number 17389299, registered office 81 Howarth Road, Wimborne, Dorset, BH21 2FG). These terms apply whenever you use acoustaplot.com or buy anything through it.
2. What Echo is, and isn't
Echo generates an indicative acoustic prediction for a room, using the dimensions and surface information you provide, based on the Sabine/Eyring statistical method and IEC 60268-16 for speech clarity. It is a design-stage prediction, not a measured survey and not a certificate of compliance. Where a formal, signed-off figure is required — for planning, building control, or a contractual obligation — that comes from a measured survey to BS EN ISO 3382-2 carried out by a qualified acoustician, not from an Echo report.
3. Accuracy of what you enter
Echo's output is only as accurate as the room dimensions and surface information you provide. You're responsible for the accuracy of what you enter; we're responsible for correctly applying the stated method to it.
4. Orders, pricing and payment
Prices are shown in GBP, and the price shown is the total you pay — nothing is added at checkout, wherever you're buying from. Payment is processed by our merchant of record, who is the seller of record on the transaction — they take your payment details directly and we never see or store your card number. Local tax (VAT, GST, sales tax) is included in that price already; the merchant of record works out and remits the correct amount for your location as part of it, rather than adding anything on top of the figure you were shown.
5. Reports, refunds and your cancellation rights
An Echo report is digital content produced and delivered in a single step at the moment you order it. Before you pay for a one-off report, we ask you to tick a box confirming that you want us to begin supplying your report immediately rather than waiting for the 14-day cancellation period to end, and that you understand you lose the right to change your mind once that has happened. The box is not pre-ticked, we record what you agreed and when, and we send it back to you in your confirmation email. If you do not tick it, we do not take payment.
That is the only thing you give up: the no-fault right to change your mind. It does not affect your right to a repair, replacement or refund if a report is faulty, not as described, or never delivered — contact us and we'll put it right. If we never supply the report, your right to cancel and be refunded in full is unaffected.
6. Echo Studio subscriptions
Echo Studio is licensed per person, not per project or per room. Monthly billing runs on a 3-month minimum term, then continues month-to-month until cancelled; cancelling stops renewal at the end of the billing period you're in. Annual billing is paid upfront for the year; cancelling stops the next year's renewal but doesn't refund months already paid for within the current year. Reports already downloaded remain yours regardless of a later cancellation.
Your 14-day right to cancel a subscription. Separately from the contractual terms above, if you are a consumer you have a statutory right to cancel a new subscription within 14 days of taking it out, for any reason. That right is not affected by the 3-month minimum term. To use it, email support@acoustaplot.com saying you want to cancel — a sentence is enough, and you do not have to explain why. We will refund you in full within 14 days of being told, and we do not charge you for the part of the period you had access to. This right is in addition to any rights you have if something is wrong with the service.
7. Acceptable use
Don't use Echo to generate reports for rooms you don't have the right to measure and describe, misrepresent a report as a measured survey when presenting it to a third party, or attempt to resell access to the service itself.
8. Intellectual property, and checking a report
A report you've paid for is yours to use, share and present as you need to. The underlying software, the absorption-coefficient database, the methodology implementation and AcoustaPLOT branding remain our property throughout, and are not published.
That does not leave you unable to check our work. If you need a report independently verified — because it is being relied on in a dispute, an appeal, or a decision somebody else has to sign off — we will release the complete input set for that report, including every absorption coefficient used and its source, to you or to an acoustician you appoint. On request, at no charge, and without requiring you to explain why. What we do not do is publish the database as a whole.
9. Liability
Echo reports are provided as an indicative design-stage prediction. To the fullest extent permitted by law, we exclude liability for decisions made in reliance on a report in place of a measured survey where one was genuinely required.
Business customers. You deal with us on the basis that reports inform professional judgement rather than replace a measured survey, and that our total liability to a business customer, in aggregate, is limited to the total fees you paid us in the twelve months before the claim arose. Any such limit is subject to the reasonableness test in the Unfair Contract Terms Act 1977.
Consumers. If you are buying as a consumer, nothing here limits your rights under the Consumer Rights Act 2015 — including your right to a repair, replacement or refund if a report is faulty, not as described, or never delivered — and any limit we rely on is subject to the fairness test in that Act. If you live outside the United Kingdom, nothing in these terms limits any right you have under the consumer law of your own country either. Where that law gives you more than these terms do, it is your law that applies, not these terms.
Third parties. A report is prepared for the person who ordered it. Nobody else acquires a right to rely on it, or to claim against us in respect of it, unless we have agreed that in writing and a reliance limit has been set in that agreement.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for death, personal injury caused by negligence, or fraud.
10. Changes to these terms
We may update these terms from time to time; the version in force is the one published here at the time of your order.
11. Governing law
These terms are governed by the law of England and Wales, without prejudice to any mandatory consumer protections that apply in your own country of residence.
If you are a consumer, you may bring proceedings either in the courts of England and Wales or in the courts of the country where you live, and we will bring any proceedings against you only in the courts of the country where you live. If you are a business customer, the courts of England and Wales have exclusive jurisdiction.
